Possession of Marijuana, Naples, Florida

Marijuana possession attorney Naples Florida Naples Florida Criminal Defense Lawyer Dominick Russo represents people accused marijuana possession in Naples.

Possession of marijuana can have serious consequences in Florida, including jail and suspension of your driver's license for two years, if adjudicated guilty. Possession of less than 20 grams is a misdemeanor, while possession of over 20 grams is a felony in Florida.

While the punishment can be severe, there are legal and factual defenses to possession. For example, where was the marijuana found? Was it found on your person, or somewhere in the car you were in. Was the search legal or not? Did you give consent to the officer to search? Where there other people in the car?

If there's a legal defense, we can file a motion to dismiss. If the search was illegal, then a motion to suppress is filed by your defense attorney.

If the charge cannot be dropped, you may qualify for a diversion program. The charge of possession of marijuana, whether a misdemeanor or felony, may be resolved with a diversion program which allows you not to have any conviction on your record of any kind. Diversion programs consist of drug testing, and possibly community service. Once the program is complete, the State drops the charge.
